22-Year-Old Human Smuggler Deported 14 Times, Arrested 15 Times

What good is deportation if they just keep coming back over and over again? For crying out loud, secure the border already and stop the revolving door!

EAGLE COUNTY — Two illegal immigrants were arrested for human smuggling in Eagle today.  One of the men has been deported 14 times for human smuggling prior to today’s arrest.  He is 22 years old.

At 8:21am a deputy pulled over a silver Chevy Venture van in the eastbound lane of I-70 for a license plate violation.  The deputy discovered 13 illegal immigrants inside the vehicle.

The driver said he planned on delivering the twelve adult males in various locations that included Denver, Iowa, and Georgia.

Omar Alaverez-Mecedo, age 22, was arrested and charged with Human Smuggling, a class three felony, and operating a vehicle without a valid driver’s license, a class two misdemeanor.

In the course of the investigation it was discovered that “Omar Alaverez-Mecedo’s” real name is Israel Robles-Gaytan.  According to ICE, Robles-Gaytan had already been caught and deported fourteen times; he gave law enforcement officials a different name each time.

Robles-Gaytan will be charged with Criminal Impersonation and 2nd degree Forgery in addition to the charges of Human Smuggling and operating a vehicle without a valid driver’s license.

Silvestre Bermudez, age 37, was arrested and charged with Possession of a Forged Instrument and Second Degree Forgery.

Both men were in the country illegally.  Alaverez-Mecedo admitted to previously being deported three times prior.

Alaverez-Mecedo and Bermudez are currently being held at the Eagle County Detention Facility with an Immigration Customs Enforcement holds and bond amounts of $15,000 and $2,000 respectively.

The eleven other occupants of the vehicle have been placed in ICE’s custody pending deportation.

A procedure recently adopted in Eagle County allowed the Eagle County deputy to take immediate action regarding immigration enforcement.

It wasn’t a handful of illegal immigrants this time. It was more like a swarm.

Border patrol agents came across a group of 85 trekking through the desert, east of Douglas, Arizona February 13.

First the agents spotted fresh tracks along the Geronimo Trail and they began to follow them. Once they found the group, agents began to interview everyone.

All 85 people were male. They told agents they’d crossed in search of work because factories had recently closed in Mexico.

They also said they’d come across from Agua Prieta, Sonora over a 24-hour period, with guides who left them just before they were apprehended.

All 85 have been voluntarily returned to Mexico.

Wire Booby Traps Designed to Decapitate Border Patrol Agents Found.

U.S. Customs and Border Protection Officials have reported finding booby traps being set by Smugglers and Illegal Immigrants along the Mexico-United States border fence in San Diego, California.

The Border Patrol has found a wire laying on the ground Saturday. This wire is slightly thicker than that of a coat hanger and designed to be invisible to anyone riding on an ATV. This wire was strung about 150 yards between San Diego’s two border fences, and lead through a hole into Mexico. The wire when pulled taunt was around four feet high if pulled from the Mexican side of the fence. This made it high enough to strike an agent on an ATV in the neck and decapitate them.

This is not the first deliberate trap set against the Border Patrol officers. On several inspections they have found holes dug and covered over on the trail. When the ATV’s or vehicles would hit these holes they would risk being thrown off the vehicles or crashing.

The recent discovery comes amid rising border violence in San Diego. Border Patrol Agents say they are increasingly under attack from people on Mexican soil, and on several occassions have been forced to retaliate by firing tear gas at the attackers.

Washington, D.C.Tonight, U.S. Congressman Duncan Hunter (R-CA) made the following statement regarding President Bush’s decision to commute the prison sentence of former aide Lewis “Scooter” Libby, while refusing to grant a pardon to convicted Border Patrol agents Jose Compean and Ignacio Ramos:

“If the President of the United States is going to commute the sentence of Scooter Libby, he should immediately accompany that with a pardon for Border Patrol agents Jose Compean and Ignacio Ramos.  Agents Compean and Ramos have been sentenced to 11 and 12 years in federal prison, respectively, for wounding a drug smuggler who was bringing 750 pounds of drugs across the border from Mexico.

“If Scooter Libby is going to receive this treatment, and there very well could be a compelling reason for the President’s actions, agents Compean and Ramos should then be provided a full pardon.

“Mr. President, pardon our Border Patrolmen.”

NOTE: Congressman Hunter introduced legislation, H.R. 563, to pardon agents Compean and Ramos.  H.R. 563 presently has 100 cosponsors.

Illegals Demand California, Threaten Violence in March, Americans Visit FBI!

Oh this one is just the cream of the crop. Not only are they protesting ICE raids to find Employers hiring Illegal Aliens (breaking the law), and arresting the illegals in this country (breaking the law), but they are trying to claim it now a “new civil rights movement”. I’m sorry but that is just a slap in the face to all Black-Americans across this country. But they also dare to demand an entire State be their Sanctuary.

“March on Saturday to demand that OUR entire state become a Sanctuary for immigrants.”

Umm excuse me, but if these individuals were legal immigrants they would not be raided, not forced to any of the woe is me dribble, and would be fully protected and welcome to live anywhere. But these people are ILLEGAL ALIENS who intentionally, deliberately, and with clear through and mind broke United States laws to enter this country under full control of their own body functions, and continue to live here being of sound mind and body to make logical and rational thoughts, without any attempt or remorse to try to become citizens or even legal immigrants.

I personally feel this is the bait. They stated they would have a violent encounter at their next march, and I feel this is a baiting by them to try to drive the American people out to counter them, then if they start any form of incident to twist it around so it is the “American peoples” fault and once again display themselves as a victim. I would suggest instead everyone print off as much of the materials citing violence, threats, invasion, take over etc as can be found and use their time wisely on that day to visit the nearest FBI office with a care package.

A congressional aide who visited Ignacio Ramos in prison said the convicted Border Patrol agent appeared emaciated, losing more than 30 pounds in solitary confinement.

Ramos, who is appealing his 11-year sentence for the non-lethal shooting of a Mexican drug smuggler, has been in a “special housing unit” since he was beaten by inmates in February at the medium-security Federal Correctional Complex in Yazoo City, Miss., said Tara Setmayer, spokeswoman for Rep. Dana Rohrabacher, R-Calif.

“He was very happy to see me, but, overall, he was very emotional,” Setmayer told WND. “He is demoralized. Languishing in solitary for 135 days takes its toll on anyone.”

The men who bloodied Ramos with kicks from steel-toed boots are in the same unit, Setmayer said.

Although the prison tries to make a distinction, she noted, “the protective measures are punitive, so he suffers all of the same restrictions as those there for disciplinary reasons.”

A lockdown had been implemented prior to Setmayer’s visit June 11, and Ramos had not received a hot meal in two days, Setmayer said.

Ramos’ wife, Monica, visited him Monday and reported he was in the same condition.

Charles Smith, spokesman for the Yazoo City prison, said he could not comment on Ramos, or any prisoner, without the prisoner’s written permission.

Ramos and Border Patrol colleague Jose Compean are serving sentences for their actions in the shooting of drug smuggler Osbaldo Aldrete-Davila-Aldrete as he fled back to Mexico after driving across the border with 742 pounds of marijuana in February 2005. U.S. Attorney Johnny Sutton gave the smuggler immunity to serve as the government’s star witness and testify against the border agents. While under immunity, the smuggler was caught in another drug delivery, but the judge sealed that information from the jury.

In another case prosecuted by Sutton, Texas Deputy Sheriff Gil Hernandez was convicted of violating the civil rights of two illegal aliens injured from shell fragments that struck them as the officer shot at the tires of a van in which they escaped from a routine traffic stop. The van driver had tried to run over Hernandez.

WND reported this week a judge reinstated Border Patrol Agent David Sipe six years after his felony conviction for striking an illegal alien who resisted arrest.

Setmayer also visited Ramos just days after the February assault, witnessing his injuries first hand.

“It was one of the most emotionally intense things I’ve ever experienced,” she said. “The hardest thing was walking out of the facility while they were handcuffing him and taking him away.”

Setmayer said that while she didn’t have to see bruises this time, she saw an “emaciated officer.”

“It just emboldens us even more so,” she said of congressional efforts on behalf of the agents, including a resolution calling for pardons. “It was encouraging for him to find out our efforts are moving forward full steam ahead.”

Rohrabacher has requested a hearing on the case before the House Foreign Affairs Subcommittee on International Organizations, Human Rights and Oversight. Among its aims, the panel wants to examine possible influence by the Mexican government on the case. Sutton has said he is willing to testify.

As WND reported, the Mexican Consulate sought the prosecution of Ramos and Compean, and also Hernandez, according to documents obtained by WND.

Setmayer said her office has been “stonewalled” by the Department of Justice in an attempt to get details of Davila’s immunity agreement and of a second attempt by him to deliver a load of marijuana across the border.

Sen. Dianne Feinstein, D-Calif., chairwoman of the Senate Judiciary Terrorism, Technology and Homeland Security subcommittee, also is examining the case.

Setmayer said more Congress members have signed on to a bill by Rep. Duncan Hunter, R-Calif., that calls for the two agents to be pardoned.

She pointed out the case has received attention recently amid discussion of whether President Bush should pardon convicted former White House aide Lewis Libby. Presidential candidates Hunter and Rep. Tom Tancredo, R-Colo., have asked how the president can consider pardoning Libby if he doesn’t pardon Ramos and Compean.

Rohrabacher says he will not endorse anyone for president who doesn’t commit to pardoning the two agents.

SAN DIEGO – Border Patrol agents in East County seized hundreds of pounds of marijuana valued at almost three-quarters of a million dollars Wednesday from a truck that was driven over the border on metal ramps.An agent was patrolling the area about two miles east of Campo at 7:30 a.m. when he noticed a suspicious-looking 2006 Nissan Frontera heading westbound on state Route 94, said Supervisory Border Patrol agent Richard E. Smith.

The agent began to follow the truck but it made a U-turn and began to drive erratically, Smith said. The truck left the paved road and headed southbound on a dirt road toward Mexico.

The agent followed the truck to the border where he found about 20 people on the U.S. side erecting the ramps so the truck could get back into Mexico. Smith said the smugglers probably alerted their accomplices that they had been spotted.

The two occupants of the truck bailed out and the whole group ran back into Mexico. One of them turned and pointed a gun at the agent but did not fire, Smith said.

Agents confiscated the ramps and the pickup in which they found 60 packages of marijuana valued at $735,000.Smith said it is not uncommon for smugglers to use metal ramps to cross the border in areas that are blocked by steel vehicle barriers. The barriers, a horizontal bar anchored to posts in the ground with large boulders beneath, are designed to stop vehicles from driving across. They are much lower than the standard border fence. Agents found a similar ramp setup last week.

The ramps may be hidden nearby or driven to a spot and assembled, Smith said.

The Border Patrol said that Mexican authorities were called after the incident but did not respond.

If you’re a burglar and someone shines a light on your activities, sure enough, you must deal with the ‘problem’ of being caught. Lott suffers distress from being exposed by talk radio. That illuminates his problems: lack of integrity and violation of his oath of office.

Lott knows no one shined a light on the 1986 amnesty. No one questioned the seven subsequent amnesties by Trent Lott, Teddy Kennedy, John McCain and the rest of those cockroaches running around the halls of Congress. No one questioned these ‘noble’ men’s disregard for enforcing those laws they created to serve a greater master—U.S. Chamber of Commerce and corporations. Today, we know Lott lies, McCain hides, Kennedy gorges and the rest of the Senate of the United States serves illegality over and above the U.S. Constitution.

“Well Aunt Bee, if you’re being lied to and cheated by politicians, what would you do?” asked Opie while rocking in the big rocking chair on the front porch in Mayberry.

“I’d call Andy Taylor to expose them for what they are doing to us common folks,” said Aunt Bee. “Or, maybe we should call the radio station…”

If not for talk radio hosts like Denver’s Peter Boyles and Gunny Bob Newman, George Putnam in Los Angeles, the John and Ken Show, Roger Hedgecock and dozens of others—Trent Lott and company would have shoved S. 1348 down America’s throat like a bar lizard drugging his victim for a date rape.

In a brilliant piece in the Magic City Morning Star, June 16, 2007, gutsy journalist Jan Herron wrote a column, “THE BAGMAN COMETH.”

“How brazen of “We, The People,” to inject our opinions into the debate!” she said. “English speaking talk radio listeners are the voices of intelligent and informed American citizens who are not buying snake oil from sell-out senators such as Trent Lott.”

Herron referred to the fact that the U.S. Senate’s amnesty bill offers American citizens a ‘bag of date-rape’ poison. She said, “Trent Bagman Lott must be referring to Spanish talk radio as to who is trying to “run” and “ruin” America. Perhaps Lott needs to tune into Spanish talk radio, I’m sure he’d feel right at home with his “pro-amnesty” compadres.”

Peter Boyles, on KHOW 630 AM exposes Bush’s support of the amnesty with a reasoned approach with expert witnesses. One of his guests, Robert Rector of the Heritage Foundation, told the audience that 103 million people would be added to America in 20 years if the bill passed. Costs exceed $2.3 trillion for American taxpayers. You could ‘feel’ a collective gasp from hundreds of thousands across the airwaves. Rector mesmerized the audience. Boyles goes eyeball to eyeball with John Temple, publisher of the Rocky Mountain News in exposing biased reporting. Roger Hedgecock’s “Hold Their Feet to the Fire” in Washington, DC in March illuminated millions of listeners across the nation of the real aspects of S. 1348. George Putnam pounds away like a U.S. Marine who never stops defending his country. Jan Herron hits the keyboard while the radio hosts speak into the microphone.

“Devious and vigorous forces want to continue the flow of illegal aliens into America,” Herron said. “Trent Lott has joined the other bagmen in trying to push through yet another amnesty against the will of the people. The scheme seems staged, the fix is in, and our comments have no place in this scheme. “We, The People” are a real threat to Lott, Graham, Salazar, Kyl, and other bagmen. They want for us to become “Unplugged.”

Herron continued, “Congress fails to represent American citizens. Are we to conclude that those who have not spoken up approve of our country being invaded with illegal aliens, or are they just “chicken little cowards” as Trent Lott? Either way, Lott or these cowards shouldn’t be in office pretending to represent us, because they do not. And these same cowards shouldn’t take for granted the tenacity of “We the People” or underestimate our willingness to do what needs to be accomplished to preserve the sovereignty of this country. We will tune into TALK RADIO as we darn well please, Mr. Lott!”

“We the People” voiced our opinions in sending the “NO AMNESTY” message to Congress last week,” Herron said. “It’s obvious Senator Trent Lott takes, “We, The People” for granted as he now has added his name to the list of bagmen singing the President’s praises.

Herron exposed little known facts: “California is a prime example of the “open borders catastrophe.” California’s 1965 population of 18 million has now doubled to over 36 million, largely from immigration. It’s projected to 56 million in 30 years, again from immigration.

“A full 96 percent of California’s 1990s-era population explosion came from immigration.

“California’s Central Valley is heavily agricultural and a breadbasket for much of the nation. Within 25 years, 50 percent of that agricultural area is slated for bulldozing to accommodate housing and services demanded by increased immigration.

“California must now build one new elementary school every day, 365 days a year to accommodate that explosion, much of it illegal aliens.

“California’s multi-year drought of the late 1970s has now spread to other Western states. Imagine the disaster when future California droughts affect 56+ million thirsty Californians!

Lawmakers Probe Prosecution of Border Agents Who Shot Mexican Drug Runner

WASHINGTON — Pressure is growing on Capitol Hill to investigate the prosecution of two former Border Patrol agents doing prison time for their on-duty shooting of a Mexican man who was transporting drugs into the United States.

Jose Compean and Ignacio Ramos are serving 12 and 11 years, respectively, for the non-fatal shooting in 2005 of Osvaldo Aldrete Davila. The agents shot Davila in the buttocks as he was transporting more than 700 pounds of marijuana into the United States through Fabens, Texas.

Davila was given immunity in exchange for his testimony against the agents.

Now the House Foreign Affairs Subcommittee on International Organizations, Human Rights and Oversight is organizing a hearing on any influence the Mexican government may have had on prosecuting Compean and Ramos.

Rep. Bill Delahunt, the Massachusetts Democrat who chairs the House Foreign Affairs subcommittee, said a formal invitation to testify will be also be sent to U.S. prosecutor Johnny Sutton “so there will be no confusion as to whether he’s available or whether he’s willing to appear.”

California Rep. Dana Rohrabacher, the ranking Republican on the subcommittee who requested the hearing, is asking for information from the State and Homeland Security departments about possible contact the Mexican government made with the U.S. government about the case.

Rohrabacher’s office has been trying to get information from the Justice and Homeland Security departments about Davila’s border crossing and parole documents to determine whether he delivered another load of marijuana in Texas in October 2005, after he entered the U.S. to have surgery by U.S. Army doctors to remove the bullet; his urethra was shattered during the shooting.

“We’ve been stonewalled unbelievably,” said Rohrabacher spokeswoman Tara Setmayer, particularly about her office’s request for correspondence from the agency investigator in the case and for details of Davila’s immunity agreement.

“It’s absurd … they claim the reason for the denial of that information is because of the privacy act. They require a privacy waiver to be signed by the drug smuggler before they can release that information.

“We want to find out what type of access he had to the country and if it was unfettered access, why would our government grant him such a privilege and also, because of the second drug bust, the relationship between that second drug bust and the dates he was supposed to have surgery in Texas.”

Documents prepared by the U.S. Drug Enforcement Administration and obtained by FOXNews.com show that on Oct. 22, 2005, Davila was identified by a witness as the driver of a 1990 Chevy Astro van that contained six bundles — approximately 752.8 pounds — of marijuana. He allegedly dropped off the load around 3 p.m. at the home of a man in Clint, Texas, in what’s known as the “October load.” The man described the van’s driver to DEA investigators, saying he was a “Mexican male, 5’10″, dark skin, 20-30 years of age, short hair, and has a colostomy bag,” according to the DEA documents.

The property owner, Cipriano Ortiz, was arrested on March 13, 2007, and indicted by Sutton’s office March 28 for having and intending to distribute over 1,000 kilograms of marijuana. He is being held without bond.

Sutton, U.S. Attorney for the Western District of Texas, left open the door of possibility that charges could still come from that incident.

“The bottom line is, we are still arresting people out of that event,” Sutton told FOXNews.com. “We’ve arrested a number of suspects out of that investigation and the investigation is ongoing.”

As for Davila, Sutton said: “As soon as we have sufficient, competent admissible evidence to charge him with a crime, we will do it.”

Justice Department spokeswoman Kimberly Smith said her department is “committed to working with Congress to answer questions and educate the public on the facts of the Ramos/Compean prosecution and has provided numerous documents explaining the court record and facts of the case to members of Congress,” including statements, transcripts and other information.

“We will continue to provide materials and answer questions pursuant to Department of Justice regulations and guidelines,” she added.

But Delahunt told FOXNews.com: “We continue to have difficulty in terms of ascertaining a date and there has been some indication that since there’s an appeal, there was hesitation on having him testify.”

Delahunt said he also met with the Mexican ambassador privately to discuss the matter, but foreign officials are prevented by protocol and the practices of the Mexican government from testifying to the U.S. Congress. As a matter of course, the congressman added, “We do not have foreign government representatives at hearings.”

“I’ve met with the Mexican ambassador. I’ve indicated to other members, including Mr. Rohrabacher, that the Mexican ambassador would be willing to meet with him and other members of Congress privately and we’re making an effort to arrange that,” Delahunt said.

As for his invitation, Sutton said he has not yet been formally asked to appear.

“I’m absolutely willing to testify before Congress and cooperate in any way with any congressional hearings or invest, subject of course, to Department of Justice regulations, rules and policy,” Sutton said, adding that he would not be allowed to talk about anything that could jeopardize pending cases. “But we also need to do the people’s business and investigate crimes and prosecute criminals.”

The department “will carefully consider any invitation for witnesses should Congress choose to hold hearings,” Smith added.

Smith said both Sutton and Justice officials “have actively sought to educate members of Congress and the American public about the facts of the Ramos/Compean prosecution.”

In a separate incident, the Mexican consulate sent a letter to Edwards County Sheriff Don Letsinger in Texas, and the FBI, pushing for Deputy Gilmer Hernandez to be prosecuted.

On April 14, 2005, Hernandez shot at an SUV full of illegal immigrants in Rocksprings as it sped off while he tried to stop it for running a red light. One of the bullets shattered the teeth of a woman inside the SUV. Hernandez reported the incident, was jailed for 266 days, and the immigrants now may be suing the U.S. government.

“Based on the Consular Convention between Mexico and the United States and the Vienna Convention on Consular Relations, the Consulate of Mexico is entitled to represent, protect and defend the rights of Mexican nationals in this country,” the Mexican consul wrote to Letsinger, Hernandez’s boss, in a letter obtained by FOXNews.com. “That is the care of my country that this kind of incidents against our nationals, do not remain unpunished.”

Sutton prosecuted that case as well.

Does the Punishment Fit the Crime?

The House Judiciary Committee also may take up the issue of federal statute known as “924c” in light of recent cases involving law enforcement on the border. It’s that statute that called for 10-year sentences for Compean and Ramos for shooting at someone who was running away.

The section of the U.S. Criminal Code says “during and in relation to any crime of violence or drug trafficking crime,” any person who uses or carries a firearm should be sentenced to no less than 10 years in prison if a gun is discharged. The law, however, does not make any allowance for law enforcement.

North Carolina Rep. Walter Jones wrote Attorney General Alberto Gonzales in October 2006 asking that Compean and Ramos not be subjected to any misapplication of the law.

“When §924(c) is applied to law enforcement officers, it is in the context of heinous crimes, such as sexual assaults, which are clearly outside the realm of official duties. The application of §924(c) in this case is overly broad, setting a dangerous precedent of application to law enforcement officers trying to act within the scope of their official duties,” the letter states.

“This is an issue that both the majority and the minority want to address and we expect a hearing to be scheduled,” said Texas Rep. Lamar Smith, the ranking Republican on the House Judiciary Committee.

On the Senate side, Sen. Dianne Feinstein, the California Democrat who chairs the Senate Judiciary Terrorism, Technology and Homeland Security subcommittee, is also looking into how Compean and Ramos were prosecuted.

“This is something Senator Feinstein has been very interested in, she has expressed interested in holding a hearing,” said her spokesman, Scott Gerber. The length of the ex-agents’ sentences and “whether they’re appropriate is a significant policy question she’d be interested in looking into,” he added.

Meanwhile, a House bill sponsored by Rep. Duncan Hunter, R-Calif., to pardon Compean and Ramos includes a provision that requires DHS to revisit engagement policies on the border — policies that even Sutton has called harsh.

“Mr. Hunter, he was worried not only for the safety of the agents but the effect this particular conviction would have on the morale and future efforts of the U.S. Border Patrol,” said Hunter spokesman Joe Kasper. “These are two law enforcement officials who are empowered as law enforcement officials to enforce our nation’s laws … these two agents were given the equivalent of murder sentences arguably, arguably … the facts of these cases do not merit 11 and 12-year prison sentences.”

Those who have rallied around Compean and Ramos worry that their case could set a disturbing precedent for how Border Patrol agents are prosecuted for on-the-job shootings and other violence, particularly at a time when there is so much pressure to strengthen border security as part of a broader immigration reform debate.

But Sutton, as well as officials at the Border Patrol and Justice Department, point out that the case was decided by a jury and there is more to the story than what’s being told.

“There’s just an extensive misrepresentation of the facts,” Sutton said. “I’d be outraged, too, if it was just two Border Patrol agents doing their job … they don’t tell you these guys shot 15 times at a guy running away, covered up a crime scene and filed false reports.

“If I had five minutes to tell the real facts, most people say ‘oh, that’s different’ … we can’t have federal agents shooting people and covering it up.”
